Welcome to LANDSEYE.com (the “Site”), provided by Docklight LLC, and its licensees, affiliates, and other related companies (“Us”, “We”, or “Landseye”). These are the terms of use (“Terms of Use”) for your use of services or features on the Site. You may be accessing our Site from a tablet, computer or mobile phone device and these Terms of Use govern your use of our Site and your conduct, regardless of the means of access.

We also like to interact with you on third party sites where we post content or invite your feedback, such as Facebook, Instagram, and Leafly (“Third Party Sites”).

Our Terms of Use and other areas of our Site provide guidelines (“Guidelines”) and rules and regulations (“Rules”) in connection with our services, including services that involve Third Party Sites, but Landseye does not control those Third Party Sites, and these Terms of Use, our Guidelines and our Rules do not apply to companies that Landseye does not own or control, or to the actions of people that Landseye does not employ or manage. You should always check the terms of use posted on Third Party Sites.

By using the Site, you signify your agreement to these Terms of Use, our Privacy Policy and our Guidelines and Rules, whether or not you have read them. If you do not agree with any of these, you should not use our Site.

We reserve the right to change or modify any of the terms and conditions contained in the Terms of Use, Guidelines and Rules from time to time at any time, without notice, and in Landseye’s sole discretion. If Landseye decides to change these Terms of Use, We will post a new version on the Site and update the date set forth above. LANDSEYE PRODUCTS

The products referenced on the Site are only available to qualified purchasers in certain jurisdictions.  Contact a representative for more details and to see if you qualify. All prices displayed on the Site are quoted in U.S. Dollars.

All material and information presented by Landseye is intended to be used for personal educational or informational purposes only. The statements made about products have not been evaluated by the U.S. Food and Drug Administration and the results reported, if any, may not necessarily occur in all individuals. All products should be used strictly in accordance with their instructions, precautions and guidelines. You should always check the ingredients for products to avoid potential allergic reactions. Use of the Site is not meant to serve as a substitute for professional medical advice. INDEMNIFICATION

You agree to defend, indemnify and hold harmless Landseye (and its officers, directors, agents, subsidiaries, joint ventures, employees and third-party service providers), from all claims, demands, losses, liabilities, costs, expenses, obligations and damages of every kind and nature, known and unknown, including reasonable legal fees, arising out of (a) your use of and access to the Site; (b) your violation of any term of these Terms of Use; (c) a breach of your representations and warranties set forth above regarding Content; (d) your violation of any law or the rights of a third party (including, without limitation, any copyright, property or privacy right); or (e) any claim that any Content you submitted caused damage to a third party. This indemnification obligation will survive the termination of these Terms of Use and your use of the Site.

The Site is created and controlled by Landseye in the State of New York. New York laws will govern these Terms of Use, without giving effect to any principles of conflicts of laws.

COPYRIGHT

GENERAL

These Terms of Use shall be governed by and construed in accordance with the laws of the State of Washington (without regard to conflict of law principles). Any claim or dispute between you and Landseye that arises in whole or in part from the Site shall be decided exclusively by a court of competent jurisdiction located in the state or federal courts located in Seattle, Washington. You expressly submit to the exclusive jurisdiction of said courts, and consent to extraterritorial service of process. Should any part of these Terms of Use be held invalid or unenforceable, that portion shall be construed consistent with applicable law and the remaining portions shall remain in full force and effect. To the extent that anything in or associated with this Site is in conflict or inconsistent with these Terms of Use, these Terms of Use shall take precedence. Our failure to enforce any provision of these Terms of Use shall not be deemed a waiver of such provision nor of the right to enforce such provision. No waiver of any term of these Terms of Use shall be deemed a further or continuing waiver of such term or any other term, and Landseye’s failure to assert any right or provision under these Terms of Use shall not constitute a waiver of such right or provision. It is the express wish of the parties that these Terms of Use and all related documents be drawn up in English.

TO THE EXTENT PERMITTED BY APPLICABLE LAWS, YOU AND LANDSEYE AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE SITE MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED.

PRIVACY POLICY

This Privacy Policy (“Policy”) describes the information we gather from you when you use the Site, mobile applications, and related services (together, the “Services”) and how we use, process, and disclose that information. We may add to this Policy with other notices. We may also post additional privacy statements for some portions of the Services. By submitting personal information through our Services, you expressly consent to the transfer of your personal data to our servers in the U.S. for our collection, use, and disclosure in accordance with this Policy. INFORMATION WE COLLECT
